- Scope
These General Terms and Conditions (hereinafter referred to as GTC) apply exclusively to legal transactions between Familie Wiesner Gastronomie AG, Zürichstrasse 131, 8600 Dübendorf (hereinafter referred to as FWG) and the customer in the context of processing orders and, if offered, booking sushi cooking courses via www.miss-miu.ch or via the order website of the respective FWG restaurant (hereinafter referred to as online services). FWG provides these services exclusively on the basis of these GTC.
By completing the order, the customer confirms that they have read, understood and accepted the GTC without reservation.
FWG reserves the right to change these GTC at any time. The version published at www.miss-miu.ch at the time of the order is authoritative.
- Availability and modification of online services
Although FWG endeavours to offer the highest possible availability of online services in line with the state of the art, it is not possible to guarantee this availability at all times. FWG is not liable for the availability of online services at all times.
FWG reserves the right to change, interrupt or discontinue the online services offered, either temporarily or permanently, with or without notice to the customer. FWG is not liable to the customer for any change, interruption or discontinuation of the online services.

The websites of FWG restaurants may contain links to other external websites or external sources. FWG has no control over the availability or content of these websites or sources and therefore accepts no liabil
- Orders
Customers can use the online services to order food and drinks for collection from the respective FWG restaurant or for delivery. The contract is deemed to have been validly concluded from the moment the customer completes the order on the respective order page.
The prices listed on the online service at the time of ordering apply. Prices are in Swiss francs, including VAT, plus delivery costs. Depending on the offer, payments can be made by credit card, TWINT or another payment method specified on the online service. The amount will be charged at the time of ordering.
Deliveries will only be made once a minimum order value, which depends on the respective delivery distance, has been reached. The minimum order value and delivery fee are based on the distance between the restaurant's location and the delivery address provided by the customer. The corresponding amounts are displayed to the customer in the online service.
At FWG's discretion, delivery can be made either by its own couriers or by delivery partners commissioned by it (e.g. Uber Eats, Just Eat).
Cancellations of orders by the customer are only permitted if they are made immediately by telephone to the respective branch and, in the case of deliveries, FWG can reach the courier or delivery partner in good time before the start of the delivery. If FWG is unable to reach the courier or delivery partner in good time, the delivery amount of the order will be charged.
The contract can only be fulfilled if the customer has previously entered truthful, current and complete information about themselves on the order form. The customer must report any errors in the entry to FWG immediately after placing the order. Personal information includes details of how the customer can be reached during delivery of the order.
The customer is obliged to be present at the time of delivery if they have selected the ‘delivery to the front door’ option. If this is not the case and the courier or delivery partner is unable to reach the customer using the information provided, the courier or delivery partner is entitled to deposit the delivery in the appropriate letterbox or take it back with them, if possible. The same applies if the customer does not pay for the delivery. FWG is not liable for any loss or damage that may result from this. If incorrect information is provided when placing an order (e.g. incorrect or incomplete delivery information or absence at the time of delivery), the delivery amount for the order will be charged.
A delayed delivery does not entitle the customer to cancel the order or demand a refund of the order price.
The resale of FWG products is prohibited.
The law prohibits the sale and free distribution of:
- Wine, beer and cider to young people under the age of 16
- Spirits, alcopops and tobacco products to young people under the age of 18

- Vouchers
Vouchers can be ordered via the online service. Once the order has been successfully placed, the voucher will be sent to the customer either by post or, if selected, in electronic form by email for printing. Vouchers are valid for two years from the date of issue and can be redeemed for FWG services within this period.
Cancellations of voucher purchases on the respective website must be made by 3 p.m. on the respective working day (or, for purchases made after 3 p.m., by 3 p.m. on the following working day) by calling 044 510 50 00, otherwise the order shall be deemed to have been fulfilled in accordance with the contract. There is no entitlement to cash payment or residual payment of the outstanding voucher amount for vouchers that have already been sent, and there is no right of return.
- Sushi cooking courses
Registration for sushi cooking courses is binding. If participation is cancelled less than 7 days before the start of the course, 50% of the course fees will be charged unless the course place can be filled by another participant. In the event of an unexcused absence or cancellation on the day of the course or after the restaurant has closed the day before, 100% of the course fees must be paid. The course management is entitled to cancel a course if there are insufficient participants or for other important reasons. In this case, the customer is entitled to a refund of the course fee.
- Redeeming discounts and voucher codes
Discount promotions allow products to be purchased at lower prices. Voucher codes and other discount promotions have a limited validity, a minimum order value and other conditions, which are specified in the respective voucher code. Details can be found in the description and conditions of the individual voucher code. Voucher codes cannot be combined with other promotions. Only one voucher can be redeemed per purchase. FWG reserves the right to take legal action in the event of misuse of discount promotions or voucher codes, e.g. misuse of email addresses to impersonate other individuals. In particular, individuals may be excluded from ordering services in future.
- Terms and conditions for debtors
The debtor invoice is due for payment within 30 days of the invoice date. In the event of non-payment, the customer shall automatically be in default and default interest in accordance with Art. 104 of the Swiss Code of Obligations shall be charged from that date. FWG shall not be liable for the fulfilment of the contract in the event of force majeure, such as, in particular, failure of telephone lines or internet connections, official measures, power failure, etc. FWG shall also not be liable for unforeseeable failure of means of transport or other unforeseeable events. - Applicable law and place of jurisdiction
All legal transactions are governed by Swiss law, excluding the United Nations Convention on Contracts for the International Sale of Goods (Vienna Sales Convention SR 0.221.211). In commercial legal transactions, Aarau is agreed as the place of jurisdiction.
